Terms of Service

By creating an account or accessing the Klinikfy platform, you confirm that:

• You are at least 18 years of age, or have parental/guardian consent if under 18 • You have the legal authority to bind your clinic or organisation to these Terms • All information you provide during registration is accurate and complete • You are responsible for maintaining the confidentiality of your account credentials

If you are using Klinikfy on behalf of a clinic or organisation, you represent that you have the authority to bind that entity to these Terms.

Klinikfy provides a clinic management platform that includes:

• Appointment scheduling and management • Automated patient reminders (SMS and email) • Patient record and clinical documentation • Staff account management with role-based access • Investigation and prescription tracking • Billing and payment management (where applicable)

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with reasonable notice where practicable.

To use Klinikfy, you must register an account with accurate information.

• You are solely responsible for all activities that occur under your account • Keep your login credentials confidential and do not share them with unauthorised parties • Notify us immediately at security@klinikfy.com if you suspect unauthorised access • We are not liable for any loss arising from unauthorised use of your credentials

We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

You agree not to use Klinikfy to:

• Upload or transmit any content that is unlawful, harmful, or infringing • Impersonate any person or entity, or falsely represent your affiliation • Attempt to gain unauthorised access to any part of the platform • Use the platform to store or process data other than as permitted under these Terms • Interfere with or disrupt the integrity or performance of the Services • Use automated tools (bots, scrapers) without our prior written consent

We reserve the right to investigate and take action against accounts that breach acceptable use policies.

Klinikfy is a platform for healthcare providers and patients. When using Klinikfy for clinical purposes:

• Healthcare providers are responsible for the accuracy and completeness of clinical records • All patient data must be processed in compliance with the Personal Data Protection Act 2010 (Act 709) and applicable medical practice regulations in Malaysia • Klinikfy does not provide medical advice, diagnosis, or treatment recommendations • The platform is a tool to support clinical workflows — clinical decisions remain solely with the qualified healthcare professional

You represent that you hold all necessary licences and approvals to practise as a healthcare provider in Malaysia.

Klinikfy offers the following plans:

• Starter (Free): Basic scheduling, up to 500 patient records, email support • Growth ($49/month): Full platform access, unlimited records, priority support • Enterprise (Custom pricing): Unlimited access, dedicated account manager, custom integrations

• All prices are in USD unless otherwise stated • Paid plans are billed monthly or annually at the time of subscription • Free tier available on Starter plan — no credit card required to start • You may upgrade, downgrade, or cancel at any time; changes take effect at the next billing cycle • Refunds are provided at our discretion within 14 days of a charge for technical issues

All content, software, designs, trademarks, and intellectual property on the Klinikfy platform are owned by or licensed to Klinikfy.

• You retain ownership of all patient data and clinical records you input into the platform • We retain the right to use anonymised, aggregated data for improving our services and analytics • You may not copy, modify, or redistribute any part of the platform without prior written consent • The Klinikfy name and logo are trademarks of Klinikfy; all rights reserved

You own all data you and your staff input into Klinikfy. Upon account closure or cancellation:

• You have 60 days to export your data via CSV or our API • After 60 days, your data is permanently deleted from our servers, subject to legal retention requirements • We are not responsible for data that you fail to export before account closure

To the maximum extent permitted by law:

• Klinikfy is provided "as is" and "as available" without warranties of any kind • We do not guarantee uninterrupted, error-free, or secure access to the platform • We are not liable for indirect, incidental, special, or consequential damages arising from your use of the Services • Our total liability for any claim arising from these Terms shall not exceed the fees paid by you in the 12 months preceding the claim

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence.

You agree to indemnify, defend, and hold harmless Klinikfy, its officers, directors, and staff from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your breach of these Terms • Your misuse of the platform or violation of applicable law • Claims brought by patients or third parties related to the clinical services you provide using Klinikfy

We may suspend or terminate your account:

• Immediately if you breach these Terms or applicable law • With 30 days' notice if we discontinue the Services or a material part of them • With immediate effect if required by law or regulatory authority

You may cancel your account at any time through your account settings or by contacting support@klinikfy.com. Upon termination, your rights to use the Services cease immediately.

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices.

• We will notify you of material changes via email or a notice on the platform at least 30 days before they take effect • Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the new terms
